These terms and conditions ("Terms and Conditions") govern the use of the portal of Petróleos Mexicanos and other related or directed portals of its subsidiaries and affiliates (collectively, the "Portal"), available at http portals: //www.pemex .com and associated subdomains, as well as certain services, interfaces and functions on the Portal, as described below. You are expected (as a "User") to carefully read the Terms and Conditions.
Your use of the Portal or the Services (as defined below) constitute an acceptance or the Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use the Portal and Services.
2.Changes to the Terms and Conditions
Petróleos Mexicanos reserves the right, to its discretion, to change, modify, add or remove any portion of these Terms and Conditions at any time without notice. You may review the most recent version of these terms activating the link "Terms and Conditions" located at the bottom of this page. You are responsible of reviewing these Terms and Conditions to identify changes avery time you use this Portal or Services; if you continue to use this Partal and the Services after Petróleos Mexicanos incoporates any of such changes, your acceptance to the new Terms and Conditions will be implied.
3.Services
The services consist of the following (jointly, the "Services"):
- (i) the provision of information from our Relationship area to Investors, including, without limitation, our annual reportas, financial statements and quarterly financial reports;
- (ii) the RSS Services (as defined bellow);
- (ii) the BDI Services (as defined bellow); and
- (iv) the disclosure of other information, charts, drawings, audio and/or image files. recordings and other miscellaneous material provided by Petróleos Mexicanos or any of its subsidiaries or affiliates.
4.Intellectual Property Rights
Petróleos Mexicanos owns all intellectual property rights related to the Services, the Portal and any written, graphic, audio, video or multimedia material contained on the Portal. The Portal and/or its elements' design, appearance, stile, tracing, selection, organization and disposition, as well as the software, codes and computer program and content that constitute and support the Portal are protected by the Federal Law of Royalties of the United Mexican States (“Mexico”) and international treaties and othe intellectual property rights.
Based on the foregoing, you may not reproduce, copy, republish, communicate, transmit, distribute, sell or market the reference material in any way without the prior written consent of Petróleos Mexicanos. Additionaly, the total or partial reproduction or modification to any section of the Portal, its design, appearance, style, tracing, selection, organization or disposition, and the reproduction, modification, distribution, republish, exhibition, compilation or reverted engineering of the software and the software code that consitute and support the Portar, without prior and written consent of Petróleos Mexicanos, is forbidden.
When accessing the Portal, you are agreeing to respect the intellectual property rights incorporated in the Portal, and you recognize the ownership of Petróleos Mexicanos on such rights; similarlly, you recognize that the simple access to the Portal does not give you any right to use the names, titles, words, phrases, marks, literary, photographic or any other material that is available on the Portal.
The brand PEMEX® an the logo of PEMEX® are registered trademarks of Petróleos Mexicanos in several jurisdictions, and therefore their use, without the prior written consent of Petroleos Mexicanos, is expressly prohibited.
Some images included on the Portal can be downloaded. When you download any image, you accept that:
- All copyrights in such images are reserved to Petróleos Mexicanos; and
- The images cannot be used for any tipe of commercial use, includig, without limitation, brochures to be publiched, use in advertismet and commercial portals, and cannot be used ider in any version, such a photographic collage.
5.Indemnification
You agree to defend, indemnify, and hold harmless Petroleos Mexicanos, its subsidiaries and affiliates, and their respective employees, contractors, officers, directors, and agents from any liabilities, claims, and expenses, including lawyers' fees, that arise from the use of the Portal or the Services (including any content you provide) or any violation of these Terms and Conditions or of the Terms of SSR Transmission and Terms of BDI. Petróleos Mexicanos reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification from your part, in which event you will cooperate with us in exercising any available defenses.
6.Limitation of Liability
You are completely responsible of your use of the Portal and the Services. You may not assert claims for damages arising from the Portal or the Services or their contents. Neither Petróleos Mexicanos nor any of its subsidiaries or affiliates shall be liable for any indirect, special, incidental, consequential or exemplary damages arising from any use or misuse of the Portal or the Services or their contents, even if they have known or should have known of the possibility of such damages.
7.Modification, Denial and Withdrawal of Access to the Portal and / or Services
Petróleos Mexicanos reserves the right to modify, suspend, discontinue, withhold or withdraw access to the Portal or the Services at any time without notice to users who do not commit to these Terms and Conditions or the terms of RSS Transmission and the Terms of BDI, as applicable.
8.Applicable Law and Jurisdiction
In case of any dispute regarding the Portal or the Services, you expressly agree to abide by the applicable laws of Mexico, and you expressly agree to submit to the exclusive jurisdiction of the courts located in Mexico for the resolution of any dispute related to Portal or the Services.
9.Disclaimer of Warranties
This Portal and the Services and all content or associated with them is provided "as it is" and without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law and Petróleos Mexicanos disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and aptitude for a particular purpose and non-infringement. Petróleos Mexicanos neither warrants nor represents that the functions contained in the the Portal or Services will be uninterrupted or error free, that defects will be corrected, or that the Portal or the server, connection and infrastructure that make the Portal available are free of viruses or other harmful components. Petróleos Mexicanos neither warrants nor represents in any way about the content of the Portal or the Services in terms of accuracy, precision, utility, opportunity, reliability or any other. Some jurisdictions do not allow the exclusion of implicit warranties, for which the above limitations and exclusions will not be applicable.
10.Third Parties Links
You may be linked to third parties portals ("Linked Sites") from the Portal. The Linked Sites are not, however, controlled or examined by Petróleos Mexicanos in any way, and Petróleos Mexicanos is not responsible of their content, availability, advertising, productos or other materials of any of such Linked Sites, any additional link contained in them. This links do not imply the backup or association of Petróleos Mexicanos with the Linked Sites. It is your sole responsibility to comply with the appropriate terms of service of the Linked Sites as well as with any other obligation under the laws of copyright, secrecy, defamation, decency, privacy, security and export related to the use of such Linked Sites and any contents therein. You must be aware that the privacy policies of the Linked Sites shall be different from the privacy policy that governs the Portal. It is your sole responsibility to read and abide by the privacy policies of the Linked Sites. 1. Introduction
The acces and use of any available RSS transmission to you through the Portal (a "Transmission", an such access and use of the "RSS Service) is provided by Petróleos Mexicanos based on the number of terms and conditions, which are completely detailed below. You must carefully read these terms and conditions ("Term of RSS Transmission"). When you download a Transmission you will be legally bound by these terms, which take effect when you start downloading such transmission. If you do not agree with being legally bonded by these terms, then you should not download any Transmission.
2. Contents
You may post on your Portal the content that is available of Petróleos Mexicanos and that you choose to receive through a Transmission (the "Content"). You will not be able to transfer or sub-licensing this right to any third party. No right given by these terms is exclusive to you. All the rights within the Content and the Transmissions shall remain property of Petróleos Mexicanos or its suppliers or outside coworkers.
You must attribute responsibility for the Transmission and Content to us by including any of the following manifestations:
- (i) “provided by PEMEX”; or
- (ii) “this article is provided by PEMEX.”
The relevant manifestation shall be incorporated prominently and fully on the side or immediately above or below the relevant Transmission or Content. You should also include and maintain any of the following on the side of or immediately above or below the relevant Content as it is displayed in your Portal:
- (i) an active link that refers to the Content as it appears on the Portal; or
- (ii) if it is not technically possible to include a link to the uniform resource locator address (URL) and / or address of the Portal from which a user could access to the PEMEX version of the relevant Content (e.g. "for the full version of this article, please visit www.pemex.com ").
You will not be able to:
- (i) edit or modify any Transmission or Content;
- (ii) use any Transmission or Content for commercial purposes; or
- (iii) redistribute any Transmission or Content.
These Terms of RSS Transmissions do not give you any right on any brand, commercial name or logo that is property of Petróleos Mexicanos, its subsidiaries and its suppliers and outside coworkers. Between you and Petróleos Mexicanos, agree that Petróleos Mexicanos owns all intellectual property in any Content, RSS Transmission and Service.
3. Behavior
You are responsible of assuring that your use of the Tramsnissions ans Content is legal in accordance with the laws of any country where you use them. You will not be able to use any Transmission or Conten in any portal that (or that include content that) would harm or might damage the reputation of Petróleos Mexicanos, the Transmissions, the Content or the RSS Services. Without limiting the foregoing, you will not be able to use any Transmission or content in any portal that includes content that:
- (i) is illegal, defamatory, obscene, profane, discriminatory, objectionable or inappropriate;
- (ii) defames, threatens, harasses, abuses or otherwise violates the rights of others;
- (iii) promotes or instructs on illegal behavior or promotes any form of violence or physical harm to others; or
- (iv) violates the rights of another person.
You cannot manifest or give the impression that your portal has been sponsored, validated, endorsed or otherwise approved by or associated with Petróleos Mexicanos.
You must guarranty that the terms of use of your portal:
- (i) reserve the totality of the rights of Petróleos Mexicanos on the Content, RSS Transmissions and Services; and
- (ii) does not allow visitors to distribute the Content or use the Content for something different to review it and print it for personal, noncommercial (in which case such visitors shall retain language allocation referred to in section 2) purposes.

4. Liability
The scope of our liability towards you has been determined in context of the following:
- (i) the access to the RSS Transmissions, Content and Services is provided to you free of charge by service without any guarantied term;
- (ii) it is your responsibility to determine the suitability of any Transmission or Content for any particular purpose to which you wish to adress it;
- (iii) you should not rely on any Content or its availability through a RSS Transmission and / or Services and you are responsible for any actions that take place or not take place as a result of the Content; and
- (iv) it is your responsibility to assure that your equipment is enabled with the appropriate and updated anti-virus software before you access any RSS Transmission, Content or Service.
While Pemex strives to ensure that the Content is accurate, we can not make any commitment to you that the Content will be accurate or complete or that any Content or RSS Service or Transmission is suitable for use. Petróleos Mexicanos can not give any commitment that the RSS Transmissions, Content, or Services will be available uninterrupted or error free, that defects will be corrected, or that the RSS Transmissions or Services, systems support or any Content are free virus or anomalies.
Petróleos Mexicanos does not accept any responsibility towards you if you do not comply, or is interrupted or delayed in the performance of the RSS Service or in providing any Transmission or Content, including, and not limited to, for the reason of:
(i) the lack of availability or failure of any telecommunication or computer, system, equipment or software service; or
(ii) any other event that reasonably is not within the control of Petróleos Mexicanos.
Specific terms for BDI Services
1. Introduction
The Institutional Database ("BDI") is an interactive tool that allows the users to access, review and manipulate the selected historic operative information of PEMEX through the website of the BDI. Subjecto to the terms and conditions estableshed below (the "BDI Terms"), these users (the "BDI Users") shall be authorized by this document to consult the information that Petróleos Mexicanos and its Subsidiaries decide to include in the BDI (the "Information"), and they can also download the information to Microsoft Excelt, make charts, sendy by e-mail the information and export it to portable devices (the "BDI Services").
2. License
Subject to the BDI Terms, Petróleos Mexicanso grants you and your employers and authorized agents (which, for the purpose of these terms shall be always referred as "you") a limited, not exclusive, non transferable, non sub-licensable and irrevocable license to access, consult, download, process, manipulate and transmit the Information and the use of the BDI only and exclusively for internal purposes of your company and not for the benefit of any other person. Without prior written consent, any other use of the BDI or the Information by any other person or entity is strictly forbidden.
3. Restrictions
- (a) You are only eligible for the license in Parragraph 2, providing you adhere to all the Terms of the BDI.
- (b) In its case, you shall not allow any other person that is nos suitable to receive the Information under the rules, regulation and other requirements of any government authority, to receive, access or consult any information.
- (c) You must attribute responsibility in terms of property and creation of the Information and the BDI Service to us, through the inclusion of any of the following manifestations:
- (i) “provided by PEMEX”; or
- (ii) “information provided by PEMEX.”
The relevant manifestation shall be incorporated prominently and completely in any document or file that contains Information in any other deploym,ent and to be shown on the side or immediately above or below the relevant Information.
You must also include and maintain an active link that reffers to the Petróleos Mexicanos Portal (www.pemex.com), beside or immediately above or below the relevant information, or if it is not technicaly possible to include a link, address the uniform resource locator (URL) and/or address of the web page of Petróleos Mexicanos.
You will not be able to:
- (i) edit or modify any Information, BDI or BDI Service;
- (ii) use any Infrmation, BDI or BDI Service for commercial purposes;
- (iii) redistribute any Information, BDI or provide the BDI Service to any third party or allow the non-authorized access to the Information or BDI Service or to publish in any other way in a public forum including, but not limiting to, printing, news brochures, radio, television or Internet.
- (iv) disassemble, use reverse engineer or otherwise decompile any software or tools included in the BDI Service, including the BDI; or
- (v) cause or permit any event that could damage or endanger the intellectual property rights of Petroleos Mexicanos in the Information, the BDI or the BDI Service.
These Terms of the BDI do not give you any right on any brand, commercial name or logo that is property of Petróleos Mexicanos, its subsidiaries and its suppliers and outside coworkers. Between you and Petróleos Mexicanos, agree that Petróleos Mexicanos owns the totality of the intellectual property of any Information, the BDI and BDI Services and any website or intellectual property contained herein.
4. Behavior
You are responsible of assuring that your use of the Information, the BDI and the BDI Service is legal in accordance with the laws of any country where you use them. You may not use any information, BDI or BDI Service in any portal (or that includes content which) could harm or damage the reputation of Petróleos Mexicanos, or of the Iinformation, the BDI or BDI Service. Without limiting the foregoing, you will not be able to use any Information or BDI Service in conextion to any content the includes or is:
- (i) illegal, defamatory, obscene, profane, discriminatory, objectionable or inappropriate;
- (ii) defames, threatens, harasses, abuses or otherwise violates the rights of others;
- (iii) promotes or instructs on illegal behavior or promotes any form of violence or physical harm to others; or
- (iv) violates the rights of another person.

Petróleos Mexicanos does not accept any responsibility towards you if you do not comply, or is interrupted or delayed in the performance of the BDI Service or in providing any Information, including, and not limited to, for the reason of:
- (i) the lack of availability or failure of any telecommunication or computer, system, equipment or software service; or
- (ii) any other event that reasonably is not within the control of Petróleos Mexicanos.
The license granted in Section 2 o the BDI Terms shall be automaticaly terminated in the event of non-compliance by you under the enforcement or perfomance or any agreement, condition, material limitation of the BDi Terms. Petróleos Mexicanos reserves the right to suspend or withraal temporarily or definitely your right to download any Information, as well as your access or use of any BDI Service at any time and by any reason. You must destroy any copy of the Information and stop accessing, using o showing any BDI Service if you are requested to do so by Petróleos Mexicanos. At any time and without notice Petróleos Mexicanos may terminate the agreement made with you under these terms, if you do not meet these terms, and you may terminate this agreement at any time by destroying all copies of the Information and refrain from use or display any BDI Service, provided that in each case, any paragraph of the BDI Terms survive reasonably and survive the conclusion. After the termination of this agreement, you shall refrain the right you have to download any Information, access or use any BDI Service.
